What happens to my pension if my employer or pension plan fails?
Pension assets are held in a trust separate from the employer, so an employer's bankruptcy does not by itself end the pension. If an underfunded private-sector defined benefit plan terminates, the Pension Benefit Guaranty Corporation (PBGC) may take it over and pay benefits up to limits set by law.
PBGC protection has boundaries. It does not cover government pensions or 401(k)-type account plans, generally does not cover church plans that have not elected coverage, and excludes some small professional-service and owner-only plans. Even for a covered plan, it may not pay the full benefit if the pension exceeds the legal limits or includes recent benefit increases. Multiemployer plans are covered by a separate program with different guarantees and rules.
Whether your plan is covered, and how much of your benefit falls within the limits, is something to confirm rather than assume.
